1 · Introduction

Hayden Baker Music LLC Services

This website (and corresponding social media sites and apps) is operated by Hayden Baker Music LLC (“Hayden Baker Music” or “we”). These Terms of Service (“TOS”) govern each user’s access to and use of this site or services provided by Hayden Baker Music (the “Hayden Baker Music Services”). The Hayden Baker site TOS includes any one or more of the following: viewing and/or using this site; the Hayden Baker fan club and all subsequent features; site contests; site email subscription list; site online store for the browsing and purchasing of merchandise and other items; email, chat, instant messaging, message boards, comments, forums, blogs, social networking, and other forms of online and/or electronic communication; the uploading and downloading of music, photos, text, video, and other audio and visual content; the viewing of and listening to audio and visual content; personalized content and other creative and/or interactive tools and activities; and any other features, functionality, materials or activities which may be available from time to time on the Hayden Baker Music Site or other online platforms.

Age Requirements

In order to access and use the Hayden Baker Music website, you must be at least 13 years of age. You may not use the Hayden Baker website if you are under the age of 13. If you are between the ages of 13-17 years, you may use the Hayden Baker Music website and make purchases from the online store only with permission from your parent or legal guardian (18+).

Legal Agreement Between You and Hayden Baker Music LLC; Visitors and Registered Users

These Terms of Service (TOS) constitute a legal agreement between the user of the Hayden Baker Music site (“you”) and Hayden Baker Music LLC. You agree and accept, without modification, all of the terms, conditions, restrictions and notices contained in this TOS in order to access and/or use the Hayden Baker Music website. Please read this TOS carefully and in its entirety. If you do not agree with all of these terms, you should leave this Site and discontinue use of the Hayden Baker Music website immediately.

TOS Modifications

Hayden Baker Music may wish to update or change this TOS on occasion to reflect changes on the Hayden Baker Music site, changes in the laws affecting the Hayden Baker Music LLC, changes in our policies, or for other reasons. When we do, we will provide notice to users in one or more of the following ways: (1) Hayden Baker Music will update the “last updated” date at the bottom of this TOS; (2) Hayden Baker Music may post notice of the update on the Hayden Baker Music Site; and/or (3) Hayden Baker Music may email notice of the update to the Registered Users. We reserve the right to make these changes and you are responsible for regularly reviewing this TOS as posted on the Hayden Baker Music Site.

Registration on the Hayden Baker Music Site

Registration may be required to use certain features on the Hayden Baker Music site. You may be required to provide information about yourself, and you are responsible for any updates to this information in order to keep it current in our systems.

Privacy Policy

At any point while you are accessing the Hayden Baker Music site, your data relating to your online communications, transactions, purchase history and/or usage patterns may be collected, analyzed and stored. Hayden Baker Music’s policies regarding its use and disclosure of your personal information are made available in the Privacy Policy. By agreeing to this TOS, you are also agreeing to the Privacy Policy. Please carefully review the Privacy Policy. The Privacy Policy shall supersede any conflicting terms contained in this TOS.

Our customer service office is open from 10am – 6pm CST, Monday thru Friday, excluding holidays. Should you have any questions, please contact Hayden Baker Music LLC. We will attempt to answer all inquiries within three (3) business days, but please allow longer.

2 · Purchasing Terms: Merchandise

Pricing and Payments

All prices available on the Hayden Baker Music website are listed in $USD (US Dollars). Full payment is required prior to shipment of any items. We accept payments online processed through PayPal, PayPal credit, and credit cards (Visa or MasterCard, American Express). Prices are subject to change.

Order Processing

All orders are processed within 48 hours of the time they are received. Orders cannot be cancelled or changed once they have been processed. If you place multiple orders within the 48 hour time-frame, we reserve the right to combine shipments into as few packages as possible to fulfill your order. Please double-check that the shipping address you provide during checkout is accurate and complete before placing your order. Your shipping address can only be changed until midnight CST of the date your order was placed.

Shipping

In-stock items are typically shipped within two (2) to three (3) business days. Orders that contain one (1) or more pre-order items are typically shipped two (2) to three (3) business days after the pre-order item(s) arrive(s) at our shipping warehouse or on the scheduled release date. Shipping may be slightly delayed on US holidays.

Orders are considered delivered once we receive delivery confirmation from the shipping carrier that the package was successfully delivered to the address you submitted at checkout. Hayden Baker Music LLC is not responsible for non-receipt of orders that have been deemed delivered. Hayden Baker LLC is also not responsible for delivery failures due to inaccurate or incomplete shipping information submitted at checkout.

At this time, Hayden Baker Music only provides domestic shipping (USA). At our discretion, we may use USPS, FedEx, or UPS for our shipping needs. Please note, we will only accept physical addresses for shipment. Your order will be cancelled and considered an “Undeliverable Package” if you use a P.O. Box at checkout. The shipping time-frames provided at checkout are estimates only. The typical delivery time-frame for USPS is three (3) to ten (10) business days. If you have not received your delivery, you must contact us within thirty (30) days of purchase or we will not be obligated to re-ship. Shipping charges are determined by the number, weight and type of items ordered, and by the shipping carrier and service selected.

Refunds, Returns and Exchanges

All sales are final. There are no refunds, returns, or exchanges on any purchases made on the Hayden Baker Music website.

Exceptions

If you have received damaged, defective or incorrectly shipped merchandise, please contact Customer Service and return the product within 30 days of receipt following the Return/Exchange Instructions below. We will gladly replace or refund the merchandise at no additional cost.

When contacting us, please include the following information:

Your order confirmation number
Your first and last name
Your mailing address
Your phone number
What you are returning and why
How you would like us to handle your return or exchange.

We highly recommend that the items be returned to us using a mail service that provides tracking or insurance.

We will provide you with a return address upon receipt of your email.

Once your return has been received by us, we will exchange your item, offer you store credit for a future purchase, or credit your credit card accordingly. Please allow 3-4 weeks for your return to be processed.

Unshipped Pre-orders

All pre-order sales are final. No refunds.

Undeliverable Packages

If for any reason your order is undeliverable and returned to Hayden Baker Music, you will be notified via email that your order has been cancelled due to a failed delivery attempt and you will promptly be issued a refund of your order subtotal. Shipping and handling fees will not be refunded. Hayden Baker Music will not attempt to re-ship any order that is returned to us without explicit consent by email with an updated address.

State Sales Tax

We are required, by law, to charge sales tax on orders shipped within certain states. Where applicable, sales tax is applied to the pre-tax order total, including shipping and handling (where required).

3 · Purchasing Terms: Tickets

Terms and Conditions for Tickets links for concerts and other events. All links that lead to third-party sites to purchase tickets for events that Hayden Baker will be performing at are under the TOS from each individual ticketing site. Hayden Baker Music LLC does not guarantee the availability of tickets or accuracy of information listed for shows on any other site other than www.haydenbakermusic.com. We also do not accept any responsibility or liability for use of any of their ticketing systems. This includes; but is not limited to, ticket cost, fees, personal information, or any other data collected from these third-party sites.

Warranty Disclaimer

HAYDENBAKERMUSIC.COM AND ITS SUPPLIERS, LICENSORS AND AFFILIATES MAKE NO REPRESENTATIONS OR WARRANTY ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS, SOUND RECORDINGS AND OTHER MATERIALS CONTAINED ON OR OBTAINED THROUGH THE HAYDENBAKERMUSIC.COM SERVICES FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS, SOUND RECORDINGS AND MATERIALS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.
